Wood burner regulations explained (UK 2026)

If you’ve seen the news recently, you might be worried that the UK government is about to knock on your door and condemn your fireplace. To clear the air: no, the government is not banning wood-burning stoves in 2026.

There is no legislation in place (or currently proposed) to ban the use of wood burners in homes. Focus has shifted entirely to what you burn and how efficient your stove is.

It’s common for news outlets to conflate ‘targets’ with outright bans. But the truth is that the government’s Environmental Improvement Plan has set a strict target to reduce public exposure to PM2.5 (fine particulate matter) by 35% by 2040, with interim targets for 2030.

However, the strategy to achieve this is not to ban stoves, but to phase out the old appliances and unauthorised fuels that cause the problem.

Is there a ban coming in 2026?

What is the ‘Grandfather clause’?

A common fear is that new rules apply retrospectively (meaning you’d have to rip out a stove you bought five years ago) – this is also false. The Ecodesign regulations (enforced since 2022) apply only to the manufacture and sale of new stoves.

While you can keep an old stove, upgrading to a 2026-ready model will use much less fuel for the same heat (and save you plenty of money in the long run).

The two rules you have to know

When it comes to current regulations, they boil down to two things: the appliance (your stove/fireplace) and the fuel. Get both of these right, and you’re fully compliant for 2026.

1. The Stove (Ecodesign)

Just as cars became cleaner to meet emissions standards, stoves also had to evolve. Where older stoves sent excessive heat up the chimney, Ecodesign stoves capture that heat and re-burn the smoke before it leaves the flue.

Since 1st January 2022, it has been illegal to manufacture or sell a new stove in the UK that doesn’t meet Ecodesign standards. These regulations are to make sure that every new stove sold today (including those by Fires2U) is a high-efficiency, low-emission machine.

2. The Fuel (Ready to Burn)

But what about fuel? Since May 2021, the government has banned the sale of ‘wet wood’ n small units (under 2 cubic metres) and phased out traditional house coal entirely (as of May 2023).

Burning wet logs is the primary cause of domestic smoke pollution. So, to be legal, firewood must have a moisture content of 20% or less.

When wood is this dry, it burns hot and clean. If it’s wetter than 20%, it smoulders, creates tar in your chimney, and releases harmful particulates. If you want to know how to spot safe wood, you don’t need a moisture metre.

Look for the ‘Ready to Burn’ logo (an orange flame icon): if you don’t see this, it’s likely illegal wet wood that will clog your new stove.

Smoke control areas

Where regulations can become particularly confusing for homeowners are smoke-controlled areas. You might have bought a brand new, efficient Ecodesign stove, but if you live in the wrong postcode, you could still be breaking the law if you don't have the right certification.

The UK is divided into ‘Smoke Control Areas’ (SCAs). These were created in the 1950s to stop the Great Smog, but they are still active today and cover the majority of UK towns and cities.

If you live in a Smoke Control Area, you MUST have a DEFRA Exempt stove to burn wood.

Distinctions

  • Ecodesign: Is the efficiency standard. All new stoves must meet this.
  • DEFRA Exempt: Is the licence to operate in a smoke-controlled zone.
